1. BASIC INFORMATION
1.1.
The General Terms and Conditions clearly contain the principles and rules for the processing personal data of the users of the services of the Ascona Trading Company, s.r.o., Radlinského 972/3, 05201 Spišská Nová Ves, ID: 50011146, Tax ID: 2120140066, VAT ID: SK2120140066, registered in the Commercial of the District Court of Košice I, Section: Sro, Insert Number: 37990/V (hereinafter referred to only as the “Operator“) provided through the webpage www.balabim.com (hereinafter referred to only as the “Services“).
1.2.
In the processing of personal data of the users of the Services, the Operator follows the Regulation of the European Parliament and the Council (EU) 2016/679 on the Protection of Natural Persons with Regard to the Processing of Personal Data and on the Free Movement of Such Data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to only as the Regulation), Act No. 18/2018 Coll. on Personal Data Protection and amending and supplementing certain Acts (hereinafter referred to only as the Act) and other related generally binding legal regulations.
1.3.
Pursuant to the relevant provision of the Regulation and of the Act, personal data is any data related to the identified natural person or identifiable natural person, who can be identified directly or indirectly, especially based on a generally applicable identifier, other identifier such as name, surname, identification number, localization data or an online identifier, or based on one or several characteristics or features that comprise his/her physical identity, physiological identity, genetic identity, psychic identity, mental identity, economic identity, cultural identity or social identity.
Within the meaning of the Regulation and the Act, the person concerned, i.e. the natural person, whose personal data is processed, is every user of the Services of the Ascona Trading Company, s.r.o., including you.
Within the meaning of the Regulation and the Act, the Operator is the Ascona Trading Company, s.r.o., which defined the purpose and the means for the processing of your personal data and processes it in its own name.
1.4.
This Privacy Policy takes effect on 25. May 2018 and it is considered to be the fulfillment of the information obligation of the Operator in relation to the persons concerned pursuant to Art. 13 of the Regulation and § 19 of the Act.
2. WHAT IS THE LEGAL BASIS AND PURPOSE OF THE PROCESSING OF PERSONAL DATA?
2.1.
By actively confirming your agreement with the General Terms and Conditions (by clicking on the appropriate box) and subsequently sending the order or otherwise marked request for the delivery of a specific service or an item:
a) you acknowledge the processing of your personal data for the purposes stated in the General Terms and Conditions, pursuant to the Regulation and the Act,
b) you confirm that the data you have provided is correct and up to date.
2.2.
I. Fulfillment of the Contract or the Adoption of Measures Before the Conclusion of the Contract
The purpose of the processing of your personal data is the delivery of goods or Services by the Operator, or the conclusion and fulfillment of the contract, which is the legal basis for the use and duration of the requested Service.
The Services of the Operator include the online store, i.e. purchase of goods or services through the webpage https://www.balabim.com/, including all domains falling under the Operator.
2.3.
In this relation the Operator recommends you to thoroughly familiarize yourself with the General Terms and Conditions of the conclusion of the contract, which are regulated in detail in the relevant documents available at https://www.balabim.com/, specifically in the General Terms and Conditions document.
2.4.
The provisioning and processing of your personal data is necessary for the delivery of the goods or services by the Operator that you requested, as well as for the closing and fulfillment of the contract, which is the legal basis for the use of the requested goods/services.
The Operator is authorized to process personal data for these purposes for 10 years after the conclusion of the last contract.
2.5.
A purpose closely related to the use of the Services is the sending of short email messages about the delivery, restocking, invoicing or other important or useful information related to your service or your item, which the Operator may send to the email address you have provided and which is registered. You can subscribe or unsubscribe to these short email messages in your registered account/profile on the webpage https://www.balabim.com/.
2.6.
II. Legitimate Interest
Other purposes closely related to the use of the Services is the analysis and statistics of the Services, which allow the Operator to improve the quality and optimization of his Services and of the webpage.
2.7.
The processing of your personal data is necessary for the purposes of direct marketing, including profiling in the extent, to which it is related to direct marketing, which pursuant to Recital 47 of the Regulation also represents legitimate interest of the Operator. This means that the Operator is authorized to process the provided personal data also for the purpose of direct marketing (commercial announcements), based on which he will be able to send you email messages with commercial content for 5 years since the last order, unless you reject this. You can unsubscribe from these commercial announcements at any time and in any way (by sending an email to info@balabim.com or by clicking on the link in the commercial announcement).
2.8.
The processing of your personal data may be necessary also for the purpose of the Operator’s legitimate interest:
a) extrajudicial and judicial exercising, provisioning and enforcement of legal claims of the Operator,
b) protection against criminal activity, reporting and proving criminal activity and cooperation with law enforcement authorities and courts in detecting criminal activity and its perpetrators,
c) protection against the misuse of the Services of the Operator and ensuring security of the webpage and the information infrastructure of the Operator,
d) for the purpose of other legitimate interests of the Operator or of a third party pursuant to the Regulation and the Act.
2.9.
III. Fulfilment of Obligations
The processing of your personal data may be necessary also for the purpose of fulfillment of obligations by the Operator arising from the Regulation, the Act and other generally binding legal regulations (e.g. Act No. 431/2002 Coll. on Accounting). Pursuant to the legal regulations, the Operator is authorized to process personal data for these purposes for 10 years after the last contract has been concluded.

By giving consent to the processing of your personal data pursuant to this Privacy Policy, you also give consent to the processing of your personal data for the purpose of creating a user account, effective marketing communication, including profiling in the extent, to which it is related to this purpose, based on which it will be shown to you at https://www.balabim.com/.
The Operator is authorized to process your personal data for another purpose, than the one specified in this Privacy policy, only if you have given him explicit consent to this or the processing of your personal data for another purpose is compatible with the purpose, for which your personal data was originally obtained. Pursuant to the Act, the processing of your personal data for the purpose of archiving or statistics is compatible with the original purpose. The Operator has established adequate and effective technical and organizational arrangements for the processing of personal data for the purposes in question, through which he ensures the minimization of personal data, as well as pseudonymization, based on which it is not possible to link the processed personal data to a specific person without the use of additional information stored separately.
3. WHAT IS THE EXTENT OF THE PROCESSED PERSONAL DATA?

The Operator processes your personal data only in the extent, which is necessary to achieve the purpose of their processing, specifically:

• name and surname,
• postal address (street, street number, city, ZIP, state)
• phone number
• mutual communication and provided goods between you and the Operator
• login data to the registered account (only if you register),
• data on visit and browsing of the webpage,
• IP address,
• cookie data;

First and foremost, your personal data is processed by the Ascona Trading Company, s.r.o. and its employees. All persons with access to the personal data are bound by professional secrecy and this obligation continues even after the termination of their employment at Ascona Trading Company, s.r.o..

As the Administrator, the Ascona Trading Company, s.r.o. authorizes other subjects for the processing of personal data, such as processors. A processor is anyone that processes personal data for the Ascona Trading Company s.r.o. for the purposes and in the manner set by the Ascona Trading Company, s.r.o. If your consent is required for the processing of your data, we give the data to the processors only if you have given this consent. 6. WHAT ARE YOUR RIGHTS RELATED TO THE PROCESSING OF PERSONAL DATA?
6.1.
We hereby inform you about the rights and legally significant facts related to the protection of your personal data arising from the relevant provisions of the Regulation and the Act:
a) you have the right to request access to your personal data from the Operator (detailed in Art. 15 of the Regulation and § 21 of the Act),
b) you have the right to request the correction of your personal data from the Operator (detailed in Art. 16 of the Regulation and § 22 of the Act),
c) you have the right to request the deletion of your personal data from the Operator, the so-called right to be forgotten (detailed in Art. 17 of the Regulation and § 23 of the Act),
d) you have the right to request the restriction of processing of your personal data from the Operator (detailed in Art. 18 of the Regulation and § 24 of the Act),
e) you have the right for your personal data to be transferred to another operator (detailed in Art. 20 of the Regulation and § 26 of the Act),
f) you have the right to object to the processing of your personal data with the Operator (detailed in Art. 21 of the Regulation and § 27 of the Act),
g) you have the right to submit a proposal to initiate proceedings of personal data protection addressed to the Office for Personal Data Protection of the Slovak Republic (detailed in § 99 through 103 of the Act),
h) you have the right to revoke your consent to the processing of your personal data at any time,
i) the provision of personal data is a requirement, which is necessary to conclude the contract and in case personal data is not provided, it will not be possible to conclude and fulfill the contract forming the legal basis for the delivery of the service you have requested.
6.2.
We draw your attention particularly to the right to object to the processing of your personal data, pursuant to which you have the option to:
a) object to the processing of your personal data in the performance of a task carried out in the public interest, in the execution of public authority or based on a legitimate interest of the Operator or a third party, including the profiling based on these legal bases,
b) object to the processing of personal data for the purposes of direct marketing based on legitimate interest of the Operator, including profiling in the extent, to which it is related to direct marketing.
6.3.
We also draw your attention particularly to the fact that you have the right to revoke your consent to the processing of your personal data at any time.
The revocation of your consent does not have any effect on the lawfulness of the processing of your personal data based on your consent before it was revoked. If you revoked your consent to the processing of your personal data and there is no other legal basis for the processing of your personal data, the Operator will ensure that your personal data will be disposed of (deletion or anonymization) as soon as possible, pursuant to the Regulation and the Act.
7. HOW TO EXERCISE YOUR RIGHTS RELATED TO THE PROCESSING OF YOUR PERSONAL DATA?
7.1.
You can exercise your rights or ask questions related to the processing of your personal data based on a request sent directly to the Operator or to the responsible person appointed by the Operator, by using any of the below-listed contacts or in any other way you choose.

7.2.
By giving consent to the processing of your personal data pursuant to this Privacy Policy, you acknowledge that if your request under section 7.1 of this Privacy Policy will be obviously unjustified or inappropriate, especially given its repeated nature, while taking into account the content of the request, the Operator can:
a) request a reasonable fee reflecting the administrative costs for the provision of information or a reasonable fee reflecting the administrative costs for its notification or a reasonable fee reflecting the administrative costs for taking the requested action, or
b) refuse to act based on the request.
7.3.
You also acknowledge that before processing your request under section 7.1 of this Privacy Policy, the Operator has to reliably verify your identity, to avoid the abuse of your rights. For this reason, the Operator may request the provision of additional information or documents, which are necessary to verify the identity of the person in question (your identity), if the Operator has reasonable doubts about the identity of the requestor. If the Operator will not be able to reliably verify the identity of the person in question (your identity) based on the above-outlined procedure, the Operator will inform the requestor about this fact accordingly, and if possible, the Operator will refuse to act based on the request.
